DMCA Policy

Kale Caesar Salad is committed to respecting the intellectual property rights of others. We comply with the provisions of the Digital Millennium Copyright Act (DMCA) and promptly process notices of alleged infringement.

This policy outlines the procedures for copyright owners to notify us of alleged copyright infringement and for users to submit counter-notifications if their content has been mistakenly removed.

Filing a DMCA Notice of Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Kale Caesar Salad website, please notify our designated copyright agent as set forth in the DMCA. For your complaint to be valid under the DMCA, you must provide the following information in writing:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright's interest.
  2. A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
  3. Identification of the URL or other specific location on the Kale Caesar Salad website where the material that you claim is infringing is located.
  4. Your address, telephone number, and email address.
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Upon receipt of a valid DMCA notice, we will remove or disable access to the infringing material and take reasonable steps to notify the user who posted the material that we have removed or disabled access to it.

Filing a DMCA Counter-Notification

If you believe your content was removed or disabled by mistake or misidentification, you may send us a counter-notification. For your counter-notification to be valid under the DMCA, you must provide the following information in writing:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Kale Caesar Salad may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.

Upon receipt of a valid counter-notification, we will send a copy to the original complaining party and inform them that we will replace the removed material or cease disabling access to it in 10 business days unless we receive notice from the complaining party that they have filed an action seeking a court order to restrain the user from engaging in infringing activity related to the material on our system.
